March 3, 2011 - Two Trenton officers are facing charges after a claim that the two abused their power as public servants during an incident in 2010. Police Chief George Warren Jr. and officer James Davenport are included on the latest Fannin County Grand Jury indictments for official oppression, a class A misdemeanor. Fannin County Criminal District Attorney Richard Glaser wanted the Grand Jury to consider the case - though they are misdemeanor charges - due to the fact that they are officers.

The indictment states that on or about Aug. 26, Chief Warren and Officer Davenport intentionally subjected Christopher Nicar to detention, seizure or disposition that the defendants knew was unlawful, and charges that the two officers were acting under color of their employment as public servants. Criminal DA Glaser reported that there was concern from the officers over a shirt worn by Nicar while working for his employer, a wrecker recovery service licensed by the state of Texas.

Rick Hagan, Davenport's attorney, commented Tuesday saying, "Jim Davenport is a 30-year veteran police officer. He was acting reasonably and did not make an arrest. The complainant has an extensive criminal history. We will vigorously defend our actions."

A call to Warren's attorney, Keith Willeford, was not returned by press time.

Glaser reported that the officers are awaiting a bond to be set by 336th District Court Judge Lauri Blake, who will try the case, and plan to turn themselves in as soon as that information is known.

It appears George Warren has a court appearance on June 16 for this case. The Fannin County website now has all court records online where you can obtain the status of a case.

There are different case numbers for each of the officers. Go to http://www.co.fannin.tx.us/ips...ords.html, click on the red Court Records link, click on Criminal Case search, in the Search By drop-down box, select defendant, and then type in their names (you'll have to do separate searches for each one). All of the case information pertaining to court appearances will display there.
